Private Labeling and Marijuana Packaging

The evolution of marijuana packaging

How it has evolved

Marijuana packaging has always been developed to meet contemporary design aesthetic standards, but now the law requires that to change for safety. It’s great for California’s economy that marijuana has recently been legalized for recreational users; The marijuana market is expected to reach $5.1 billion by 2019. This figure is the highest ever forecast for beer sales in 2019. This is a hurdle for dispensaries and product manufacturers, however, who now need to ensure that all their items meet the legal requirements for packaging that came with legalization.

Some of the new laws are simple, but others are more complicated and require businesses to revamp their policies to ensure they comply. Legalization in California began on January 1, 2018, and businesses were given an additional 6 months to put their items in order; So, starting July 1st, if your California dispensary or cannabis company that sells products in California is not in compliance with the new rules, it is now in violation of the laws.

Hospital requirements

Most dispensaries are familiar with the new laws that require products to be contained in tamper-proof bags, but few are aware that there are also new packaging rules for other items such as pre-rolls, edibles and bud containers. You can find a complete list of requirements on the California Department of Public Health website here.

Without complying with these new laws, dispensaries could face fines or have their business licenses revoked. The results are dire for clinics and frustrating for consumers who depend on their favorite stores. Learning about these new regulations and ensuring that packaging meets the new standards as soon as possible is the best way to ensure that you don’t end up with fines or closures altogether.

Child-proof marijuana packaging

According to the CDPH, not only are there new laws that require dispensaries to use tamper-proof, child-resistant exit bags to cover all purchased products, but there are also new laws that prohibit any packaging that is attractive to children and just plain generic. Food names are allowed to be used as descriptions of foods. These regulations are well-intentioned but make the compliance movement more complex than simply printing new labels for packaging. Dispensaries and product manufacturers will now have to come up with new names and campaign plans for some or all of their products, which may mean ordering all new packaging items and containers.

It doesn’t have to be a difficult process to be compliant. Biohazard is anticipating these new laws and since the announcement of the new laws they have child resistant, ASTM approved bags, jars, joint tubes for marijuana packaging.

Flower and concentrate packaging

Safe bags and less child-inviting product names and packaging, labels and containers for bud flowers, pre-rolls and concentrates need to comply with new laws. CDPH says:

– Cannabis (flower and pre-rolls containing only flower) must meet the basic requirements described in the Trade and Business Code: Section 10, Chapter 12

– Pre-rolls that contain only flowers must comply with all packaging and labeling standards outlined in the California Business and Professions Code.

– Pre-rolls that contain both flower and concentrates (“infused pre-rolls”) must complete all packaging and labeling requirements for manufactured products, as set forth in the MCSB Regulations for Cannabis Growers.

In short, these regulations mean that new labels with specific language must be present on all containers and new regulatory stickers must also be placed on all containers.

There are many dispensaries around the Los Angeles area that still won’t even close under the new laws; We have recently seen shops that sold us flower pots without labels. It’s not against the law anymore, but it’s a little frustrating for consumers who might be trying a new strain and then not remember what they bought because the container doesn’t have a label.

We’re not saying these are black market shops, but last June, California Governor Jerry Brown proposed funding to send five teams dedicated to investigating shops operating illegally. Forcing hospitals to comply with the new regulations will only become more pressing over time, so it’s best to prepare now.

Labeling and direct printing

Deciding on labels and packaging can sometimes be an uncomfortable task to navigate, especially when time is limited. A lot of time can be wasted looking for the right marijuana packaging and labels only to find that the one you want doesn’t exist.

Biohazard anticipates future requirements for labels complying with the new law as well as new specific labeling for businesses restructuring their labeling and packaging policies. Not only do we have California Compliant RX labels, but we also have RX labels available for Colorado and Washington.

We know that even if a business complies with the new RX label and child-resistant bag and container laws, they may still have to comply with new packaging and labels that make their products less desirable to children.

Fortunately, Biohazard also specializes in custom marijuana packaging and printing! This is especially convenient for businesses that need to renew the appearance of their products to comply with new laws, as we can quickly provide quality packaging even with minimum orders. Our packaging and labels are also BPA-free acrylic and fully compliant, approved and tested.

One of the great benefits of our custom printing program is that businesses can choose whether they want to print their design on the label or directly on the packaging. With the new security regulations, we can easily make new packages as requested so there is no worry of fines or license revocation.

We know the new packaging and label laws are frustrating, but Biohazard has everything any marijuana establishment needs to comply with the new regulations. We don’t want to fall under any company when we are here to provide all the services you need to stay in business!
